Terms of Service

1. Eligibility and accounts

• You must be at least 13 years old, and old enough to form a binding contract where you live.
• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly at support@chefaide.com if you suspect unauthorized access.
• One person may not maintain multiple accounts to evade limits, restrictions, or suspensions.

2. Your content

You may import, create, and store recipes, images, notes, pantry items, and other content ("Your Content"). You keep ownership of Your Content. You grant ChefAIde a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display Your Content solely to operate, secure, and improve the Service for you.

You represent that you have the rights necessary to submit Your Content and that it does not violate these Terms, any law, or anyone else's rights. When you import recipes from third-party websites, you are responsible for respecting those sites' terms and the rights of their authors. Imported recipes are for your personal, non-commercial use.

3. Acceptable use

You agree not to, and not to help anyone else to:

• Upload or create content that is unlawful, infringing, defamatory, obscene, hateful, harassing, violent, or sexually explicit, or that exploits minors.
• Upload content you do not have the right to share, including copyrighted text or photos, or other people's personal information.
• Post recipes or instructions intended to cause harm, such as content promoting dangerous, toxic, or illegal substances, or deliberately misleading food-safety or allergen information.
• Use the Service to send spam, run scams, or engage in phishing or other fraud.
• Scrape, crawl, or bulk-download the Service or its content, or use automated means (bots, scripts) to access the Service except through features we provide.
• Abuse our AI features, including submitting excessive requests, attempting to bypass usage limits or safety filters, or using the Service to generate content unrelated to cooking and meal planning.
• Probe, scan, or test the vulnerability of the Service, bypass authentication or access controls, or access other users' accounts or data.
• Interfere with or disrupt the Service, including by introducing malware or placing an unreasonable load on our infrastructure.
• Reverse engineer, resell, sublicense, or commercially exploit the Service without our written consent.
• Misuse the Instacart integration, including generating shopping lists for fraudulent purposes.
• Impersonate any person or entity, or misrepresent your affiliation with anyone.
• Violate any applicable law or regulation.

We may remove content or restrict features at any time if we believe it violates these Terms or harms the Service or other users.

4. AI-generated content

ChefAIde uses artificial intelligence to extract, generate, and summarize recipes, nutritional information, and images. AI output can be inaccurate or incomplete. Always review ingredients, quantities, cooking times, temperatures, and nutritional information before relying on them.

5. Food safety, allergies, and health

The Service is provided for general informational purposes only and is not medical, nutritional, or dietary advice. You are solely responsible for verifying that recipes and ingredients are safe for you and anyone you cook for, including checking for allergens, following safe food-handling practices, and cooking food to safe temperatures. Consult a qualified professional for dietary or medical needs.

6. Instacart purchases and third-party services

ChefAIde can create shopping lists on Instacart from the ingredients you select. ChefAIde does not sell groceries and is not a party to any purchase you make. All orders, payments, substitutions, deliveries, refunds, and customer support for purchases are handled by Instacart and its retail partners, and are subject to Instacart's terms and privacy policy.

Product matches, availability, and prices are determined by Instacart and its retailers and may differ from the recipe. Review your cart before checking out. ChefAIde is not responsible for third-party products, services, websites, or content, including recipe sources you import from.

7. Subscriptions and payments

• Some features require a paid subscription. Prices and features are shown before you subscribe.
• Subscriptions are billed in advance through Stripe and renew automatically each billing period until you cancel.
• You can cancel at any time from your subscription page. Cancellation takes effect at the end of the current billing period, and you keep paid access until then.
• Except where required by law, payments are non-refundable, including for partial billing periods.
• If you cancel or a payment fails, your account may revert to the free tier and recipes beyond the free-tier limit may be archived and eventually deleted.
• We may change pricing with advance notice. Changes take effect at your next renewal.

8. Intellectual property

The Service, including its software, design, logos, and content we provide (other than Your Content), is owned by ChefAIde or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms.

9. Copyright complaints

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to support@chefaide.com that includes your contact information, a description of the copyrighted work, the location of the infringing material, a statement of good-faith belief that the use is not authorized, a statement that the notice is accurate and that you are authorized to act, and your physical or electronic signature. We may remove infringing content and terminate repeat infringers.

10. Suspension and termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access, remove Your Content, or refuse service at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us, or engaged in fraud or abuse. Sections that by their nature should survive termination will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT RECIPES, NUTRITIONAL INFORMATION, OR AI OUTPUT WILL BE ACCURATE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEFAIDE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, ANY RECIPE OR FOOD PREPARED USING THE SERVICE, OR ANY THIRD-PARTY PURCHASE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.

13. Indemnification

You agree to indemnify and hold harmless ChefAIde and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you through the Service or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. General

These Terms are governed by the laws of the United States and the state in which ChefAIde is established, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and ChefAIde regarding the Service.
